Lyon was one of the original plaintiffs in the Supreme Court's landmark Heller decision which recognized the Second Amendment guarantees an individual's right to possess a firearm for traditionally lawful purposes, such as self-defense within the home.  Later Mr. Lyon was a plaintiff in the DC District Court's Palmer decision which compelled the District of Columbia to issues permits to residents and nonresidents for the concealed carry of firearms.    

On August 3, 2016, Arsenal Attorneys filed Wright, et al v. Depending on your own state's law, the Arsenal Gun Trust™ helps you obey gun control regulations, reduces the legal risks of handling restricted firearms, and helps your loved ones inherit your firearms safely, lawfully, and privately. The Arsenal Gun Trust™ is particularly important for firearms regulated by the National Firearms Act (NFA). NFA firearms are sometimes called Class 3 or Title II firearms. They include silencers (also known as suppressors), short barrel rifles (SBR), short barrel shotguns (SBS), and machine guns (fully automatic).

It is important to note that some political leaders have called for an expansion of the NFA rules to nearly all firearms. Thus, now and in the future, gun owners need to address the issues we present in this tutorial: compliance, risk, and inheritance. We'll begin by focusing on firearms currently regulated by the NFA.

Comply with Gun Laws

The NFA regulates the ownership of SBRs, SBSs, machine guns, and silencers, in those states where they are permitted. Frustratingly, the possibility to own NFA-regulated firearms can vary within different cities and counties within the same state, because the local Chief Law Enforcement Officer (CLEO) may personally decide whether to sign the forms required by the Federal Bureau of Alcohol, Tobacco, Firearms and Explosives (BATFE) to own NFA firearms.

Fortunately, the law and well-established BATFE policies offer you an alternative. Rather than applying through your local CLEO to own NFA firearms as an individual, you may instead apply directly to BATFE by using a legal entity (such as a gun trust), avoiding the need for a CLEO's signature, fingerprints, or mug shots.

Meet our Attorneys

Meet the leadership team of Arsenal Attorneys. We lead a staff of attorneys licensed to serve clients in 40 states.

Matthew J. Bergstrom, Managing Attorney 

Matthew Bergstrom portrait by Alyona Vogelmann

Matthew Bergstrom serves as Managing Attorney of Arsenal Attorneys™, a law firm he started in 2010. He possesses over 20 years of combined legal and business experience helping clients pursue opportunities and reduce risks. He personally leads the firm's Arsenal Gun Trust™ practice, which has served thousands of clients in over 30 states. His work has been featured in numerous media outlets, including the Wall Street Journal, the Washington Times, and in various TV and radio programs.

Mr. Bergstrom's currently concentrates in the areas of estate planning and firearms regulations. He was previously active in international business and consulting. Mr. Bergstrom began his career in Russia and Europe. He also served as a consultant in global affairs, security, technology, and finance for an investment banking firm and for Fortune 100 senior executives in San Francisco, New York, and Washington, DC. He has taught various topics in the law for the American Bar Association, the Federal Bar Association, the Financial Planners Association, and other organizations.

In addition to his practice of law, Mr. Bergstrom is an entrepreneur and academic. He founded and leads a successful e-commerce venture. He serves as an Adjunct Professor of History at William Jessup University, where he also serves on the Board of Advisors for the school's Institute for Public Policy.

Mr. Bergstrom earned his law degree from the Maurer School of Law at Indiana University in 1997. During law school he served as Executive Editor of the Federal Communications Law Journal. The University awarded him the Elliot R. Lewis Scholarship and an International Fellowship with the Ministry of Foreign Affairs of the Kyrgyz Republic. He received an MBA in international business and marketing from the Helsinki School of Economics, and he graduated from Michigan State University's James Madison College with a Bachelor of Arts in international relations and Russian. He is a member of the bar in California, Virginia, Michigan and the District of Columbia.

Mr. Bergstrom divides his time between Arsenal Attorneys' offices in California and metropolitan Washington, DC. Whenever possible he enjoys his time with his wife, three children, and three dogs on the family's farm.

 

George L. Lyon, Jr, Attorney at Law

George L. Lyon, Jr. has represented clients in complex legal matters for more than 35 years as a member of the Virginia, District of Columbia and Supreme Court bars, as well as the bars of several lower federal courts. He is an experienced litigator in both civil and administrative forums, as well as before appellate courts. Areas of the law of particular interest to Mr. Lyon are: constitutional law, communications law, employment law, business disputes, and criminal defense.

He earned his law degree in 1979 from the Marshall Wythe Law School of the College of William and Mary where he served on the William and Mary Law Review. He holds a Bachelor of Arts in Law and Society from the University of Virginia where he was special projects and production editor of The Cavalier Daily and a member of the Jefferson Literary and Debating Society. He is the author of “Ethical Responsibilities of Defense Counsel in the Juvenile Court” published in the Journal of Juvenile Law.

Mr. Lyon was one of the original plaintiffs in the landmark United States Supreme Court decision, District of Columbia v. Heller.

Jay R. Pelkofer serves clients in estate planning as well as business matters, real estate law, and landlord/tenant issues.

Mr. Pelkofer earned his law degree in 2005 from the Georgetown University Law Center in Washington, D.C. During law school, Mr. Pelkofer served on the Georgetown Journal of Legal Ethics where he co-authored a published law review article titled, “Lawyers, Ethics, and Fees: Getting Paid Under Model Rule 1.5”. Mr. Pelkofer also served as a law clerk for a small firm in Maryland that focused on real estate and small business transactions. He is a member of the Virginia bar.

Upon graduating from Georgetown Law, Mr. Pelkofer joined the estate planning practice of Greenberg Traurig, LLP. He handled numerous trust and estate planning issues including Complex Wills, Revocable Living Trusts, Powers of Attorney, Advanced Medical Directives and numerous other estate planning issues. In 2008, Mr. Pelkofer opened his own legal practice.

Mr. Pelkofer earned his bachelor's degree with a dual major in finance and economics from Robert Morris University in Pittsburgh, PA. After graduating Summa Cum Laude from Robert Morris, Mr. Pelkofer worked for several years in the financial services industry as a financial advisor for American Express and as a senior fund account manager at Mellon Bank.

Mr. Pelkofer earned his graduate degree in public policy analysis at the H. John Heinz III School of Public Policy and Management at Carnegie Mellon University. He is a twice-awarded W.W. Cooper Merit Scholar. During his summer internship at the Allegheny Institute for Public Policy his research thesis regarding land use and development, urban sprawl, and eminent domain was published in several local newspapers including the "Allentown Morning Call," and the "Bedford Gazette." Upon earning his graduate degree, Mr. Pelkofer worked at the U.S. Government Accountability Office for several years working on various federal tax policy issues.
